Welcome to my new blog…web log, that is to us few technology-challenged newcomers. The title is "Union Eyes" as I hope to have my perspective shaped by viewing the world through the lens of labor.

I hope to share with you my thoughts, concerns, updates and surprises as they happen in a “stream of consciousness” format. That is, I’ll write this as I experience it.

You might find a several posts in one day and then not see one for a while as this is not a journal or daily column. As news breaks or as thoughts break, I will break out the keyboard and communicate.

So, let’s begin this journey together. I will pledge to share with you what I’m reading and tell you what I’m thinking in a straight and unvarnished way and hope you will share your thoughts with me as well. FURLOUGH IMPLEMENTATION RESOLUTION BEGUN
Two messages were clear at the Town Hall meetings - one was Council 81 was moving full-steam ahead to develop furlough implementation language and two was you wanted Council 81 to move full-steam ahead to develop furlough implementation language.

Friday, we met with Governor Markell to begin discussions of the process for implementing the furlough language. We plan to begin meeting sometime this week with OMB officials and the presidents of affected AFSCME locals to begin crafting the language.

Please continue to send your suggestions to your local president.

OVERTIME LANGUAGE - UNFAIR LABOR PRACTICE
As we stated in the Town Hall meetings last week, we will file unfair labor practice actions this week for overtime language, changes in disability language and other changes the State of Delaware unilaterally imposed on AFSCME members without negotiating these mandatory subjects of collective bargaining.

FURLOUGH PROCESS IN MOTION! - SEND YOUR PRESIDENT YOUR IDEAS AND INPUT
Yesterday and early this morning, letters were sent to eight state departments requesting the designation of someone from the agency to meet and discuss the development of plans for implementation of furlough policies.

This morning, letters to the five school district superintendents will be sent.

Local Presidents will join with us as we meet to craft workable plans which are, according to the recently passed law, "fair and balanced."

UNFAIR LABOR PRACTICE (ULP) FILED ON OVERTIME
An unfair labor practice action was filed by Council 81 to force state agencies to negotiate overtime provisions was filed earlier this week.

We look forward to the State's response to the PERB (Public Employment Relations Board) and an expedited hearing schedule to resolve the issue for you as quickly as possible.

IF THEY CAN PUT SOMEONE ON THE MOON, THEY CAN...
Forty years ago today, we walked on the moon, but how long will it take to resolve the furlough or overtime issue?

We are working to meet as quickly as possible with the eight departments and five school districts to make a furlough plan that works for you. Your local president will be involved in these discussions and will bring your thoughts and ideas to the table. Make sure you communicated with your local president to make your views known.

We are awaiting a response to our unfair labor practice action on the overtime issue and will pursue it vigorously for you.

WHAT ARE WE DOING, WHAT SHOULD WE BE DOING AND WHERE DO WE STAND?
Council 81 has been working to ensure that you are treated fairly and justly in the unfavorable fallout of the FY 2010 Budget which was passed by the Legislature. For documents on the budget, see the headline below.

These actions by the State of Delaware and unilaterally imposed on AFSCME members without negotiating these mandatory subjects of collective bargaining are, in our belief, unfair and we will stand up for your rights.

We are committed to fighting for the overtime language we had in the Merit Rules prior to July 1, 2009 and are working to have an orderly, fair and equitable system for the five furlough days.

Please continue to send your suggestions to your local president.

OVERTIME LANGUAGE - UNFAIR LABOR PRACTICE
As we predicted in the Town Hall meetings and in this blog, we filed an unfair labor practice action for overtime language and must now go through the process of a hearing with the PERB (Public Employment Relations Board).

This may take some time, however, we must follow the process required by the law for a successful outcome. Please help us and yourselves by keeping detailed records of your time worked and the time as you are presently required to submit it by your agency. We will need this record in order to be sure you are properly compensated when we achieve our goal.

KEEPING YOU INFORMED - HOW CAN WE IMPROVE?
The process of keeping everyone informed is a great concern for all organizations and especially here at AFSCME Council 81.

We publish this blog so that every member can read what we're doing and answer as many questions for you as wel can. We take your phone calls and email messages and with the answers we provide to you, highlight them in the blog so that if others have the same question(s), we make sure everyone has the same answer.

Help us with your suggestions.

We also send an email to your local presidents and ask that they send this to you either through their email network or if not possible, to post it on each union bulletin board so that you may be informed.

PRESIDENTS' MEETING YESTERDAY
AFSCME local presidents attended a Presidents' meeting. Topics were the state of the unfair labor practice actions filed for overtime, short-term disability, career ladder promotions, pay cuts and furloughs.

The presidents heard a presentation by Courtney Weaver, AFSCME International who is working with Make America Happen and Health Care America Now! concerning the crucial votes we have in Delaware. Congressman Castle for bipartisan support of healthcare in the House of Representatives and Senator Carper in his position on the Senate Finance Committee.

BECOME A PEOPLE MVP
The Executive Board of Council 81 discussed the PEOPLE Campaign and encouraged all board members and presidents to lead by example and sign up at MVP level.

Curt Ostrander, AFSCME International led a delegation of Local presidents to reach an agreement with the State Agency heads on furlough and floating holiday language. The agreements have two more steps in the process, the approval by the various cabinet secretaries and then OMB.

Thanks again for your input and involvement and your president's hard work on this.

HAPPY LABOR DAY! - YOU MAKE LABOR HAPPEN - YOU MAKE DELAWARE HAPPEN!
Today we celebrate labor's contribution to this great state and nation. Labor has brought about working and social changes that would have otherwise never happened in this country. We continue to work - and work hard - for economic and social changes that make not only labor, but all we serve, live in a better world.

Today, harsh economic realities and the fears they have engendered have caused some to question the viability of labor. Some have even counted us out. I don't believe that and don't question that at all - Labor, especially AFSCME is strong and growing in Delaware. With each passing day, labor unions are being bombarded with people who are asking how to join and participate.

AFSCME's organizing effort in Delaware is growing and we're experiencing people seeking the protection and representation of organized labor to carry their concerns to their employers and elected officials.

With every downturn, every change, some would throw in the towel, however, unions were not formed for the "good" times, unions were and are formed to make the good times. If we're going to be in an economic struggle, let's struggle together to make a better tomorrow.

LABOR DAY HIGHLIGHTS
GOVERNOR ISSUES EXECUTIVE ORDER REINFORCING THE RIGHT TO ORGANIZE
Labor Day is always a great day at AFSCME Council 81 and this Labor Day was no exception, however, it was made better by Governor Jack A. Markell's signing ceremony of Executive Order 10 "Executive Order Number Ten - State Employees And The Right To Organization And Effective Union Representation" reinforcing the right to organize.

The signing ceremony was held on the announcing platform for the Labor Day parade at Rodney Square. Many AFSCME members and the unrepresented future members AFSCME is organizing attended and spoke to the assembled crowd including AFL-CIO officials, leaders of other labor organization and elected officials.

The Governor and I both reiterated the importance of an atmosphere free from fear and intimidation and as the Joint Governor's Office / AFSCME Council 81 Press Release states "an executive order that "affirms the Governor’s support for the state and federally protected right of Delaware State Employees to organize and form their own union."

THE GREEN MACHINE MARCHES
Thanks to all who marched with us in the 11th Annual Delaware State AFL-CIO Labor Day Parade. With AFSCME Green T-Shirts, the great AFSCME Green Machine contingent marched along King Street with pride and flourish.

FURLOUGH - SECTION 25 LEAVE - AN AFSCME SUCCESS STORY
Moments after the passage of H.B. 295, AFSCME Council 81 began working on the details of making sure its members were not disaffected by the terms and conditions of taking the required five furlough days.

We created a special webpage for you to share your ideas and you responded with great suggestions that were incorporated into the ultimate negotiated agreement.

Drafts of proposed language were distributed to locals and vetted by their individual committees and synthesized to meet the various needs of the many agencies and members.

In a landmark effort, all the local presidents within the eight departments met with the AFSCME International Negotiator Curt Ostrander, Council 81 Staff Representatives and OMB HR officials to hammer out a workable agreement.

Two key provisions concerning use-it-or-lose it annual leave and redesignation of previous annual leave were negotiated to the employee's favor at this session.

Our thanks go to you for your ideas and patience and to your leadership for working those ideas with us into language eight departments are using to administer the Furlough – Section 25 leave.

As the battle for health insurance reform enters the critical final stage, I wanted to give you an update:

The Senate Finance Committee’s bill was reported out last week. As you know, we’ve had serious concerns about this bill for a while. As President McEntee discussed at last month’s IEB meeting, the White House asked us to hold our criticism during the SFC deliberations. Sadly, the bill that was voted out of committee is deeply flawed. It does not meet ANY of our basic principles for real reform. 

Therefore, AFSCME, joined by more than two dozen other unions, ran a full page ad opposing this bill   in the Washington Post, USA Today, and publications covering Capitol Hill: Politico, Roll Call and The Hill. The ad Our Bottom Line for Health Care Reform, reiterates our commitment to real health insurance reform and our bottom line principles: a public option, affordability, no taxing our benefits, and employers paying their fair share.

The ad has received considerable press attention, including a piece in Politico. Our positions were topics of discussion on the Sunday morning political talk shows, including NBC’s “Meet The Press,” CNN’s “State of the Union” and ABC’s “This Week.” It is important to note that we do not subscribe to the frame that we are in conflict with the White House. Indeed, we are fighting FOR President Obama’s health care plan and AGAINST the insurance lobby and its unprecedented effort to kill real reform and protect the status quo. We have worked closely with the White House and will continue to do so. What we will not do is compromise our core principles and our dedication to our members and all working families.

AFSCME’s leadership in this fight has been noted over the weekend in some prominent progressive blogs, including DailyKos and Firedoglake. AFSCME’s field and affiliate program has been, and will continue to be, a key part of our effort. On Oct. 20, we had nearly 60 press and house party events across the country as part of a national call-in day to Congress. Themed “Time to Deliver,” the coalition generated more than 300,000 calls to the House and Senate.

These activities will influence the negotiations currently underway in Congress, as leadership and the White House iron out details of the Senate bills and the three committee bills in the House – all in preparation for floor votes next month and then final passage.

3.)   After leaving a message (see sample below) for Senator Carper, repeat the steps to let Senator Kaufman and Representative Castle know you support a public health insurance option with no taxes on benefits!

Call Senator Carper, Senator Kaufman, and Rep. Castle right now and urge them to support health care reform including a public health insurance option, to bring down costs and give us the peace of mind to know our families will get coverage no matter what happens to our private insurance.

The United Negro College Fund operates this program as an innovative strategy aimed at expanding the minority workforce of AFSCME throughout the United States.
